Dr. Johannes Fiala (48) teaches civil law and insurance law in the insurance course. He also designs the lecture series “Liability Risks for Intermediaries” and is available to the course management with advice and assistance in all insurance law and also didactic questions. Dr. Fiala is one of the few lecturers who have had a decisive influence on the course of studies from the conception phase to the present day. After training as a banker (Bankhaus H. Aufhäuser in Munich/Frankfurt, Bayerische Landesbank), he studied law (LMU Munich). He completed his studies in economics and business administration with a “Master of Business Administration” (MBA Financial Services, Univ.) as well as the certificate as a “Certified Financial and Investment Advisor” (A.F.A., in the Lloydsbank London, plc group). A specialist lawyer training (Munich Tax Academy) was followed by postgraduate studies in the areas of legal profession (University of Hagen), Financial Planning (Hochschule für Bankwirtschaft, Frankfurt/Main), European Communities (inter alia Centre for Science “Schloss Hofen”, Russian Academy for the State Service to the President of the Russian Federation – Moscow, Centre International de Formation Europ�enne) with graduation as “EGExpert (C.I.F.E.)”. The study of psychology (FIM, Univ. Erlangen-Nuremberg) was followed by a training in mediation (Meditor Univ.) and a degree as “Master of Mediation” (MM Univ.). He gained practical professional experience at home and abroad in asset management (also on behalf of various courts), in real estate sales, industry (Siemens AG), management consulting (Roland Berger), the insurance industry (Münchener Rückversicherungs- Gesellschaft AG, Allianz Versicherungs-AG), with auditing companies (Datag AG, Treuarbeit AG), as a court-appointed expert (financial services sector), as a member of the legal committee of the European Association of Self-Employed Persons, and as an IHK examiner for the Fachberater and Fachwirt für Finanzdienstleistungen. In addition, he is known – and sometimes feared – in the industry as the author of numerous publications on current issues of insurance and intermediary law. For example, he obtained the well-known ruling of the Munich Regional Labour Court on occupational pension schemes: this states that, in the case of deferred compensation, an employer is liable for ensuring that, in the event of a change of employer, the employee has claims at least in the amount of the contributions paid in. This means that zillmerized pension insurance tariffs will become much less attractive in the future.
