Financial investments for guardians, wards and benefactors – a legal and financial analysis

In many statutes of foundations, but also in guardianships, the assets are to be invested “gilt-edged”. Moreover, according to the law, the return has to be in an appropriate proportion to the risk. The work offers for the bank and insurance selling a regular manual for the consultation of guardians and donations for the optimization of the capital and fortune investments. For the first time, the editors have bridged the gap between business management and the law with this work. The legal requirements of the legislator, which have existed for over 100 years, have been brought into line with the findings of Nobel Prize winner (1990) Prof. PhD. Harry Markowitz. The interdisciplinary team of authors is made up of qualified social workers, qualified administrators, bankers, financial and investment advisors, qualified sociologists, financial advisors, judicial officers, lawyers, business economists, Masters of Financial Consulting, mathematicians, publicly appointed experts, actuaries, Certified Financial Planners, Certified Estate Planners and financial planners. The work first introduces the legal principles of ward money investment. The focus is on providing the business and financial knowledge to assist the guardian or foundation advisory board in selecting gilt-edged investments. The authors discuss the possibilities of proper financial planning and explain appropriate instruments for evaluating the profitability of investment products; in particular German and English life insurance policies. At the same time, practice-relevant “pitfalls” of gilt-edged investments and the possibilities of circumventing them are pointed out. The authors attach importance to an understandable representation and do to a large extent without legal technical terms. In the way of the topic preparation and linguistic organization the manual addresses itself therefore for example to credit institutes and insurance companies. The publication is also of great interest to field staff as contacts for financial investments.
