Lawyers warn brokers of liability traps: The implementation of the EU Insurance Mediation Directive will require brokers to provide extensive advice and documentation in the future. However, many of these basic requirements have not yet been defined. The Munich lawyer Johannes Fiala therefore warns brokers and software manufacturers not to be lulled into a sense of security. To the documentation programs already available on the market so far he expressed himself in the current issue 10 December 2006 / January 2007 of portfolio international as follows: “What I have seen so far are at best helpful and relatively complete checklists of what needs to be queried during a customer conversation. However, it is important – and this has been confirmed again and again in the past years – to record the course of the conversation in all details. To the best of my knowledge, none of these protocols guarantee that.”
