We also reported in DA-No. 38B/06 and 40B/06 that (…) – the Munich attorney Johannes Fiala with reference to the BGH criminal judgements of 11.11.04 and 07.03.06 stated: “After our legal opinion the initiator will be exposed then to the Untreueverdacht after ? 266 StGB, if it selects no commission-free tariffs, concludes instead however expensive commission-obligatory tariffs, from which commissions flow into its economic interest range, without the investors being cleared up over it.
